Terms of Service

These terms govern your use of formpuppy, operated by Pairtok Co.,Ltd. (株式会社ペアとく) ("we", "us", "our"). By using our service, you agree to these terms.

1. Service Description

formpuppy provides AI-powered email filtering for businesses. We receive emails on your behalf, classify them using AI, and forward legitimate emails to your specified address.

2. Account Responsibilities

• You must provide accurate account information
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use this service
• You are responsible for all activity that occurs under your account

3. Acceptable Use

You agree not to:

• Use the service for any illegal purpose or to transmit illegal content
• Attempt to disrupt or interfere with the service
• Use the service to send spam or unsolicited emails
• Reverse engineer or attempt to extract the source code
• Share your account credentials with others or create multiple accounts

4. AI Classification

Our AI classification is provided on a best-effort basis. While we strive for accuracy, we cannot guarantee that every email will be classified correctly. You acknowledge that some legitimate emails may be filtered and some spam may be forwarded.

5. Free and Paid Plans

The free plan includes a monthly email processing limit. Emails exceeding this limit are forwarded without AI filtering. Paid plans with higher limits may be offered in the future.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.

We are not liable for any damages caused by misclassification of emails, including but not limited to missed business inquiries or forwarded spam.

8. Termination

We may suspend or terminate your account if you violate these terms. You may stop using the service at any time. Upon termination, your data will be retained for a reasonable period to allow for data export, after which it will be deleted.

9. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.

12. Data Processing Addendum (GDPR)

This section applies where you use formpuppy to process personal data of individuals located in the European Economic Area (EEA), the United Kingdom, or other jurisdictions with equivalent data protection laws.

12.1 Roles

You ("Controller") instruct us, Pairtok Co.,Ltd. ("Processor"), to process personal data on your behalf. Processing consists of receiving, classifying via AI, temporarily storing (up to 90 days), and forwarding emails sent to your formpuppy address.

12.2 Details of Processing

• Subject matter: AI-powered email filtering and forwarding
• Duration: The term of these Terms of Service
• Types of personal data: Sender email address, name (if included in the email), and email body content
• Categories of data subjects: Third-party individuals who submit contact forms on your website

12.3 Processor Obligations

We will:

• Process personal data only on your documented instructions; your use of the service constitutes such instructions
• Ensure that personnel authorized to process personal data are bound by confidentiality
• Implement appropriate technical and organizational security measures pursuant to GDPR Article 32
• Engage sub-processors only with your prior general authorization; by accepting these terms you grant general authorization for the sub-processors listed at formpuppy.com/sub-processors. We will provide at least 30 days' notice before adding new sub-processors
• Assist you in responding to data subject rights requests under GDPR Articles 15–22
• Assist you with your obligations under GDPR Articles 32–36 (security, breach notification, data protection impact assessments)
• Delete or, upon written request, return all personal data upon termination of the service
• Make available all information necessary to demonstrate compliance with this addendum and allow for reasonable audits

12.4 Data Breach Notification

We will notify you without undue delay, and in any event within 72 hours, upon becoming aware of a personal data breach affecting data processed under this addendum.

12.5 Data Subject Requests

If we receive a request directly from a data subject concerning personal data processed on your behalf, we will promptly forward it to you so that you can respond.
